  • DIOSAP utilizes third-party plugins to enhance website functionality. DIOSAP does not claim ownership of such third-party software and is not liable for any bugs, security vulnerabilities, or disruptions caused by these plugins. but for best security practices we give social sign by google option during registration and login. it is users responsibility to use two factor authentication for their google accounts to keep their account secure.

Introduction

These Terms and Conditions govern the relationship between:

  • DIOSAP (Service Provider)

  • Restaurants using DIOSAP services

  • Customers of the restaurant  

when ever the words like “you”, “your”, “user”, “users”, “visitor”, “visitors” are used in this page this means DIOSAP is referring to restaurants, customers of restaurants and all the visitors of this website. when ever the word “we’ is used it refers to DIOSAP.

By using DIOSAP’s website and services, you agree to these terms.

1. Restaurant related

  • It is restaurants responsibility to give their restaurants terms & conditions for their customer, once the terms and conditions are given by restaurant DIOSAP will include them here along with DIOSAP terms and conditions.

2. Order related

  • Once an order is placed by Restaurant’s customers it is restaurant responsibility to process the order and complete the order. DIOSAP is not responsible for any order related things.
  • Restaurant and its customers order information may expire after 1 day and it may get deleted from database so it is the respective restaurant and its customers responsibility to download their order information.
  • Minimum Order for Delivery:  If restaurants provide  food delivery service to their customers then restaurants should clearly mention their condition regarding delivery in restaurant website. Also it is duty of the customers of restaurant to know about the conditions of food  delivery service by restaurants. DIOSAP is not responsible for this.

3. Refunds

  • Wallet points Refunds: 
  • wallets loyalty cash back points will not be refunded for partial cancelation or full cancelation of order once the order is placed by restaurant’s customers using their wallet points, only the real actual money spent on that order will be refunded to customers by their restaurants and DIOSAP is not responsible in this issue. 
  • Money Refunds: Money refunds by Restaurants to their Customers will be processed within 7 days, excluding bank holidays and period may extend depend on the payment gateway refund timings and complexity of problem related to refund. Restaurants are responsible for any refund of the order and initiation of refund process immediately since they handles the refund payments of their customers using payment gateways. DIOSAP is not responsible for this
  • Money refunds should be made by Restaurants only after refunding all the wallet points applied by their customers. then DIOSAP will process wallet points refund as mentioned in above point.

4. Disclaimer

  • Image Disclaimer: 
  • The images displayed on Restaurant’s website are for reference purposes only and may not reflect the actual items served.  restaurant should provide actual images of their items to DIOSAP so that DIOSAP will upload them to the restaurant website. It is also restaurant’s responsibility to provide content and any description to DIOSAP about their items. DIOSAP is not responsible for any wrong information about the items displayed in the restaurant website.  
  • Food Responsibility: 
  • Restaurants are responsible for providing the food items to its customers as per the customers order but DIOSAP is not responsible for that, DIOSAP is  just a digital service provider. However, the images of the food items are provided by DIOSAP if the restaurant has not given the actual food item images for DIOSAP, and these images provided by DIOSAP are for reference purpose only and sometimes images may be wrong also so DIOSAP is not responsible for its content. DIOSAP is also not responsible for the taste, quantity, quality of the food items  ordered  by customers of restaurant and also any kind of mistakes or fraud or cheating done by the restaurant to its customers.

5. Payment

  • DIOSAP is not responsible for any issues caused by payment gateway failures or any other transactions related issues. Restaurant have to contact the restaurant’s website integrated payment gateway for any money & transactions related problems.  For money and transactional related problems restaurant’s customers should first approach the restaurant and should inform about problem.
  • Payment getaway transactional charges will be applied to restaurants that are using payment gateway for their transactions. Restaurants and its customers are also obeys the privacy policy and terms and condition of payment gateway that they is being used for restaurant.

6. Account Management

  • Account Inactivity: For Customers of Restaurants, Accounts that are inactive for six months may be deleted, once the account is deleted all the data related to them will be deleted.
  • Resaurant’s customers wallet funds will expire after 90 days once credited in to restaurant’s customer account.
  • Password Reset: Customers of Restaurants can request a password reset through the Restaurant contact form, and a new password will be sent to their registered email by the Restaurant staff. DIOSAP is not responsible in the matter of password changing or reset password it is the restaurant duty to change password.
  • Customers of Restaurants can request restaurants to delete their account through contact form. restaurants should inform to DIOSAP regarding such customers through email then once in every month DIOSAP will delete account of those customers who requested for their account deletion.

7. Tips

Tips to servers and chefs of restaurants are optional and are directly paid to their bank accounts through Google Pay or Phone Pay QR codes. It’s totally restaurant’s customers wish to pay the tip or not. DIOSAP and Restaurant are not responsible for any issue related to tips.

8. Data Collection

DIOSAP may collect certain data, including date, time, page URL, user IP, name, and email of all visitors of  the this website to improve DIOSAP services and ensure security,  also please read and accept the privacy policy mentioned above this terms and conditions.

  1. Other information:
  • If restaurants wants to renew DIOSAP’s restaurant digital service after the connection is disconnected then restaurants needs to pay an extra amount other than their recharge amount.
  • DIOSAP will disconnect the connection after the  recharge expire. If Restaurant recharge expires DIOSAP is not responsible for the wallet funds or any data deletion related to the Restaurant and its customers after Disconnected.
  • DIOSAP is not responsible for Restaurants and its Customers for any issues caused by server down time or server crashes or any hacking by others or data breaches. If any issue arise DIOSAP will use the latest backup due to this some of the recent data related to restaurant and its customers will be lost from the last backup taken.
  • DIOSAP is just a digital service provider and not responsible for any restaurant issues. regarding any issues Related to restaurant then Restaurant’s customers should contact Restaurant manager or owner only.
  • Restaurants should regularly read the about us page in diosap.com regarding DIOSAP’s services and features, It may change time to time.
  • Promotional emails by DIOSAP and Restaurant regarding offers, special items and any news emails will be automatically subscribed by all users during registration. if you don’t like to get promotional emails then you can unsubscribe them by clicking on unsubscribe in your promotional email.
  • Restaurants should send promotional emails to  customers only after their business hours.
  • At any time DIOSAP may increase the price of its service if server prices or third party technology’s that we are using goes high in the market.
  • If Restaurant gets blocked by server company due to any misuse or spam of emails then DIOSAP is not responsible for that and Restaurant website may go down or may be removed and may require to create website again on the new server with the last backup available which will be having data loss since the last backup and Restaurant have to bear that applicable extra price again.
  • Any issue related to restaurant caused by server will take time to solve depending on the scenario, it may be hours or it may be days, DIOSAP is not responsible for any inconvenience caused. 
  • Restaurants should upgrade their plan to next plan if restaurant data grows beyond our DIOSAP standard plan. DIOSAP will inform to Restaurants once their data consumption reaches to DIOSAP recharge plan server limits. 
  • It is restaurant duty to check also the spam folder of their email accounts for any emails sent by DIOSAP or its customers. 
  • It is restaurant’s customer duty to check also the spam folder of their email accounts for any emails sent by their Restaurant or DIOSAP.
  • It is restaurant duty to check table card on their restaurant tables regularly time to time so as to know that scanning QR code leads to their restaurant website. DIOSAP is not responsible for any kind of fraud related to table card issues. So we always recommend you to check the url of the scanned  QR of table’s card should match with the domain name given to your restaurant.
  • It is restaurant’s customer duty to check table card on their restaurants dining table so as to know that scanning QR code leads to correct restaurant website. DIOSAP or Restaurant are not responsible for any kind of fraud related to table card issues. So we always recommend you to check the url of the scanned  QR of the tables card should match with the domain name of restaurant.
  • Any disputes with Restaurant’s customer  bill or invoice should be brought in to notice of the Restaurant manager immediately within one hour through email and also through directly in person  meeting with manager.
  • DIOSAP is not responsible in any matter related to table and chair reservations and its related issues, customers of restaurant should approach only restaurants in this matter.
  • In case of reservations Customers should confirm their reservation with restaurant and should be available at restaurant 10 minutes prior to their reservation time. 10 minutes grace time will be given by restaurants to its customers for reporting at restaurant for their reservation before cancelling the reservation slot. For example if the customer reserved table or chair at 2 pm then restaurants will wait till 2:10 pm for customers to report at the restaurant. if the customer fails to repost before 2: 10 pm then restaurants have the right to cancel the reservation slot even though it is a paid reservation and amount paid by the customers will not be refunded.
  • in case of pre-booking food to the reservation time then the reserved food will only be served if that is available on that reservation dine in day. if the pre-booked food is partially or fully not available then customers paid amount for that food will be refunded by restaurants.

10. Website Ownership & intellectual property rights:

  • All rights, title, and interest in the website, including but not limited to the design, structure, logos, slogans and website code, functionalities and domain name remain the exclusive property of DIOSAP, others do not have the right to copy them. The restaurant is granted a non-transferable, revocable license to use the website for the duration of the subscription only.
  • The restaurant may request changes to branding elements such as logos, menu items,  However, the core website design, software, and features remain standard and they are the exclusive property of DIOSAP.
  • Restaurant’s Failure to renew the subscription may result in the restaurants domain being revoked or sold or allocated to another restaurant.
  • If the restaurants fails to renew the subscription within 7 days of the due date, DIOSAP reserves the right to suspend or permanently delete the website and all associated data which also includes restaurant’s customers related data.
  • users of this website are strictly prohibited from copying, duplicating, reselling, or reverse-engineering any part of the DIOSAP platform. Any unauthorised attempt to replicate the DIOSAP system will result in immediate termination of services and potential legal action.

10. Governing Law

Any disputes with DIOSAP will be resolved in the courts of Andhra Pradesh state in INDIA and proceedings will be in Telugu language only.
